It is seen that even the earlier private notice that was ordered on 15.04.2024 was served on the respondent on 13.05.2024 and it has been duly acknowledged. Subsequent private notice that was sent pursuant to the order passed on 13.06.2024 has been returned with an endorsement "No such person". The service is complete.

2.This Civil Miscellaneous petition has been filed seeking to condone the delay of 134 days in preferring the Civil Miscellaneous Appeal. 3.Heard the learned counsel for the Appellant and perused the records. 4.Having satisfied with the reasons assigned in the affidavit filed in support of this petition, this miscellaneous petition is allowed and the delay of 134 days is condoned.
