ORDER

This writ petition is filed for a mandamus directing the first respondent to allow and ensure that the participation of the petitioners in the XXVI National Deaf Senior Sports Championship organized by the All India Sports Council of the Deaf which will be held at the Chandrasekeran Nair Stadium, Trivandrum, Kerala from March 26th to 29th of 2025.

2. The grievance expressed in the writ petition is that all these petitioners are eligible and qualified to participate in the event being conducted by the first respondent. However, their position remains uncertain and there is a likelihood that they may not be permitted to participate in the event, which is scheduled to begin tomorrow (i.e.26.03.2025)

3. An urgent lunch motion was moved today (i.e.25.03.2025). This Court requested Mr.Prasad Vijaykumar, one of the learned Senior Panel 2/5

Counsels for the Central Government to get instructions from the Sports Authority of India and the matter was passed over.

4. The learned Senior Panel Counsel appearing for the second respondent on instructions from the Sports Authority of India, would submit that the event is purely conducted by the first respondent, who is a private authority and the decision who will be admitted or not is only within the domain of the first respondent. They have no say over the matter. The same is recorded.

5. However, in the meantime, the learned counsel appearing on behalf of the petitioners would submit that an email was also sent to the first respondent with reference to the filing of the petition and the email was immediately responded to by the Honorary General Secretary of the first respondent.

6. It is stated that there is no rejection of athletes from participating in the events. The Tamil Nadu State Federation has already sent the entry forms two weeks ago, on 12.03.2025 and the entries have been finalized. Hence, 3/5

they are not understanding on what ground the petition has been lodged. The e-mail also states that perhaps there is no coordination with the state union for the confirmation and for this confirmation, they have also attached the entry list with the athletes' names. The e-mail further mentions that such matters are unhealthy and will result in the decline of the unity of the athletes as a whole.

7. The learned counsel appearing for the petitioners submit that upon reviewing the list, the petitioners may have no grievance and will be allowed to participate tomorrow (i.e.26.03.2025)

8. Recording the above, the writ petition stands closed. Consequently, connected miscellaneous petition is closed. No costs. 25.03.2025 1/2 nsl 4/5
