A Chidambaram, v. Dr S Rajagopal

2024-04-15Honourable Mr Justice C.V. Karthikeyan1 pages

Application No. 2082 of 2024 C.V.KARTHIKEYAN, J.

This application is filed seeking to grant an extension of time for further period of four months to complete the Arbitration Proceedings, which are pending before the learned Arbitrator.

2. In the affidavit filed in support of the judges summons, it had been stated that there was a writ petition in W.P. No. 25552 of 2023, which is pending and it was part of a batch cases relating to the applicability of Section 77-A of Registration Act whether the said provision is prospective or retrospective in nature. Therefore, the outcome of the said writ petition was crucial to decide the issue and the Arbitration proceedings could not be completed within the statutory period.

3. Taking all factors into consideration, six months time is granted for completing the arbitration proceedings, though in the petition, only four months time is sought.
