By consent the writ petition is taken up for final disposal. 2.The petitioner claims that Asha foundation is a trust registered with registration no.661/99, has decided to stat a college of education to promote education to the "downtrodden and poor
people" residing in and around Thiruvannamalai District and accordingly submitted an application to start B.Ed. Course to the second respondent and on inspecting the instructional and infrastructural facilities, approval was accorded on 04.03.2009 for the college for conduction B.Ed. Course from 2008 onwards. The second respondent has also accorded approval and granted affiliation. The first respondent has also granted affiliation vide proceedings dated 01.04.2007.
3.The petitioner would further state that as per the present norms National Council for Teacher Eduction (NCTE) for increasing the intake of existing courses and for starting new course, the existing B.Ed. Colleges have to fulfil the following norms apart from the infrastructural, instructional and financial capacity and they are as follows:
"a)Institution offering teacher education programme for a minimum period of five academic years.
b)Being affiliated to a University c)Having applied for accreditation from NACC or any other accrediting agency approved by NCTE. d)No objection Certificate from affiliating Body". 4.The petitioner wants to increase the intake of the students studying in B.Ed course and accordingly submitted an application dated 14.04.2015 after complying with all the formalities and since no orders have been passed, came forward to file this writ petition. 5.Mr.R.Kannan, learned counsel appearing for the petitioner has drawn the attention of this Court to the letter of NCTE dated 15.06.2015 addressed to the Secretary, Higher Education Department, Government of Tamil Nadu, Chennai, wherein the said official was requested to furnish the recommendations for not conducting B.
Ed-AL programme in the State by the above mentioned colleges within 30 days from the date of the reminder letter so as to enable them to process the applications as per the regulations in force. In the light of the same time has been extended till 14.07.2015 and hence there cannot be any impediment on the part of the first respondent to consider the application submitted by the petitioner and prays for appropriate orders.
6.This Court heard the submissions of Mr.R.Kannan, learned counsel appearing for the petitioner, Mr.U.Venkadesan, learned counsel appearing for the first respondent and Mr.K.Ramakrishna Reddy, learned Standing Counsel appearing for the second respondent.
7.This Court without going into the merits of the claim projected by the petitioner directs the first respondent to consider and dispose of the petitioner's representation dated 28.05.2015 in accordance with law on or before 08.07.2015 and communicate the decision taken, to the petitioner. The writ petition is disposed of accordingly. No costs.
