..Contemnor(s) Prayer:- Contempt Petition is filed under section 11 of the Contempt of Court's Act to initiate appropriate contempt proceedings against the respondents for non-compliance of the order dated 31.01.2025 passed by this Honorable Court in W.M.P.Nos. 3653 and 3655 of 2025 in W.P.No. 3291 of 2025 For Petitioner(s):

M/s.M.Elumalai For Contemnor(s):

Mr.Abisheik Moorthy, Govt. Advocate for R.1 to R.4.

ORDER

The above Contempt Petition has been filed on the ground that there has been a breach of order of stay granted by this Court on 31.01.2025 in WMP.Nos.3291 of 3653 and 3655 of 2025 in WP.No.3291 of 2025. 2.WP.No.3653 of 2025 has been filed challenging the order passed by the 3rd respondent therein who is the 1st respondent herein dated 25.09.2023 in and by which the 3rd respondent had directed the Revenue Records relating to the lands comprised in Ward No.A, Block No.3, Old SF.No.2/7 and 2/8, corresponding to new T.S.No.2/2 measuring 0.3650.00 sq.mtrs and S.No.2/4 measuring 5.0050.0 sq.mtrs. in Zagir Ammalapalayam Village, Salem West Taluk, Salem District to be changed/re-classified without notice to the interested parties. The petitioners therefore challenged the said order and sought for a stay of operation of the same. Therefore, by reason of the stay granted by this Court on 31.01.2025, the order of the 3rd respondent/1st respondent herein directing the change or reclassification of the subject land stands stayed.

3.A perusal of the affidavit filed in support of the contempt petition would show that there is nothing to prove as to how the stay order passed by this Court on 31.01.2025 has been breached. On the contrary, the petitioners' have alleged that the mutation of the revenue records in respect of the subject land has not taken place. By reason of the stay, the respondents are restrained from effecting any change in respect of the subject land. 4.The contention of the petitioners in the affidavit appears contrary to the order of stay. Therefore, no contempt is made against the respondents and consequently, the contempt petition stands dismissed. No costs. 18-12-2025 Index: Yes/No Speaking/Non-speaking order SHR
