The petitioner, who apprehends arrest for the alleged offences punishable under Sections 406 and 420 of IPC in Crime No.65 of 2024 on the file of the respondent/police, seeks anticipatory bail.
2.It is the case of the prosecution that the petitioner and one Sivakumar approached the defacto complainant for taking his JCB Hitachi for monthly rent of Rs.1,00,000/-. The defacto complainant and the accused have entered into an agreement and advance amount was also paid by the petitioner. After few days the defacto complainant came to know that the petitioner has sold the JCB Hitachi for Rs.9,50,000/-. Hence the complaint. 3.The learned counsel appearing for the petitioner would submit that he is a law abiding citizen and he is willing to comply with any condition set forth by this Court. He undertakes to furnish sufficient security and surety in the event of releasing him on anticipatory bail and shall abide by any condition imposed by this Court. Hence he prays to grant anticipatory bail to the petitioner.

ah 4.The learned Government Advocate (Crl. Side) vehemently opposed for grant of anticipatory bail to the petitioner. The petitioner herein is the habitual offender. Vehicle recovered. The worth of the vehicle is Rs.40 lakhs but the petitioner herein put it in the scrap for Rs.9,50,000/- and through GPS only the defacto complainant came to know that the petitioner herein sold the JCB and made a loss to the defacto complainant to the tune of Rs.40 lakhs. 5.Heard the learned counsel for the petitioner, and the learned Government Advocate (Crl.Side) and perused the materials available on record. 6.Taking into consideration the facts and circumstances of the case and the submissions made by the learned Government Advocate (Crl. Side) and considering the gravity of the offence and also taking note of the fact that the case is at initial stage and it needs detailed investigation. Hence, this Court is not inclined to grant anticipatory bail to the petitioner. 7.Accordingly, this Criminal Original Petition stands dismissed. 2/3
