(CRIME NO.08 OF 2021) For Petitioner : M/S.MF.SHABANA Advocate For Respondent : MR.A.GOPINATH Govt. Advocate (Crl. Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner who apprehend arrest at the hands of the respondent police for the alleged offence under Sections 7, 7A, 12 of Prevention of Corruption (Amendment) Act, 2018 and 120 B of IPC in Cr.No.08 of 2021 on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that the petitioner is alleged to have received a sum of Rs.1 Crore from the defacto complainant inorder to get lighting work contract for the defacto complainant and thereafter cheated him.

3.The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and that she has been falsely implicated in this case. The learned counsel further submitted that the daughter of the petitioner has committed suicide and hence, anticipatory bail may be granted to the petitioner.

4.The learned Government Advocate (Crl. Side) submitted that earlier, the petitioner approached this Court by filing Crl.O.P.No.6710 of 2021 and this Court has dismissed the said petition.

5.Considering the gravity of the offence committed by the petitioner that she being the Joint Chief Engineer (now under suspension) in the Highways Department, has received a sum of Rs.1 Crore from the defacto complainant as bribe and since there is no change in circumstances subsequent to the order passed in Crl.O.P.No.6710 of 2021, I am not inclined to grant anticipatory bail to the petitioner.

6.Accordingly, this criminal original petition is dismissed. However, liberty is granted to the petitioner to file petition seeking parole before appropriate forum.
