ORDER

Contempt Petition has been filed to punish the respondents for wilful disobedience of the order passed by this Court and Sub Application has been filed to direct the respondents to submit the original fixed deposit receipt to the Registrar General.

2.In the Arbitral Proceedings, this Court directed the respondents herein to deposit 50% of the award on 21.10.2021. Later modification was sought by the respondents, the same was dismissed vide order dated 05.01.2022 with a direction to deposit the amount ordered earlier within a week. That amount has been deposited which is not in dispute. However, the original fixed deposit receipt has not been produced before this Court. 3.Now, it is the contention of the respondents that the application has been filed and when they sought to produce the original fixed deposit receipt, the Registry did not accept without any application being numbered. At this stage, this Court is of the view that this type of petition is for nothing but abuse of process of law and wasted the time of Court.

4.As long as there is no dispute with regard to deposit and orders of the Court has been complied. Merely because the fixed deposit receipt has not been produced, the contempt will not arise. Such view of the matter, the respondents shall produce the original fixed deposit receipt before the Registrar General, the Registrar General shall receive the same since the amount has already been deposited.

5.Accordingly, this contempt petition is closed. Consequently, connected sub application is also closed.
