Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a writ of Mandamus directing the Respondent herein to consider and pass orders on merits and in accordance with law on the Review Petition of the Petitioner dated 10.05.2020 with regard to reinstatement into service within time frame.

O R D E R

Petitioner has come up with this Writ Petition seeking a direction to the Respondent to consider his Review Petition dated 10.05.2020 with regard to reinstatement into service, in accordance with law.

According to the Petitioner, he was served with a Charge Memo in P.R.No.28/2019, dated 28.08.2019 under rule 3(b) of the Tamil Nadu Police Subordinate Service Rules. However, the allegation contained in the Charge Memo has not been substantiated during the oral enquiry. He has further stated that, the Enquiry Officer in a biased manner, has held that, the charges as proved in violation of the Statutory Rules and on 29.11.2019, the Petitioner was dismissed from service by the https://hcservices.ecourts.gov.in/hcservices/

Commandant and the same was confirmed by the Inspector General of Police, Armed Police in his proceedings dated 20.02.2020. Aggrieved by the said capital punishment, the Petitioner preferred a Review Petition before the Respondent herein on 10.05.2020, seeking reinstatement into service and the same is pending.

Heard the learned counsel on either side and perused the material documents available on record.

In view of the limited prayer sought for by the Petitioner, without going into the merits of the case, the Respondent is directed to afford an opportunity of personal hearing to Petitioner or ask him to put forth his Written Submissions either through e-mail/Speed Post within a period of two months from the date of receipt of a copy of this order and pass appropriate orders on the Petitioner's Review Petition dated 10.05.2020 on merits and in accordance with law within a period of two months thereafter.
