ORDER

The petitioners apprehend arrest for the alleged offence under Sections 303(2), 326(a) of BNS Act read with Section 21(1) of Mines and Minerals Act, in Crime No.61 of 2026 on the file of the respondent police seeks anticipatory bail.

2. The allegation against the petitioners is that the petitioners was found in illegal transportation of 1 unit of river sand in a tractor. Hence, the case.

3. The learned counsel for the petitioners would submit that the petitioners are innocent persons and they have been falsely implicated in this case. He would further submit that the petitioners are ready to abide by any stringent conditions that may be imposed by this Court and hence, he prays for grant of anticipatory bail to the petitioners.

4. The learned Government Advocate (Crl. Side) would reiterate the prosecution case and submit that the petitioners have three previous cases. Hence, he opposed for grant of bail to the petitioners.

5. Considering the fact that petitioners have previous cases, this Court is of the view that the petitioners does not deserve anticipatory bail.

6. Accordingly, this Criminal Original Petition is dismissed. 25.03.2026 sma 2/4
