Criminal Original Petition is filed under Section 482 of Cr.P.C.,to direct the fourth respondent -C.B.C.I.D., to investigate the case in Cr.No.185 of 2009 by Superintendent of Police, C.B.C.I.D.(Metro) without reference of letter dated 30.06.2009 issued by Dr.Vallinayagam in an un official manner, file the report within the stipulated time.

Criminal Original Petition is filed to direct the fourth respondent -C.B.C.I.D., to investigate the case in Cr.No.185 of 2009 by the Superintendent of Police, C.B.C.I.D.(Metro), without reference of letter dated 30.06.2009 issued by Dr.Vallinayagam in an un official manner and file the report within the stipulated time.

2.Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents.

3.The learned Additional Public Prosecutor submitted that a case in Cr.No.185 of 2009 under Section 174 Cr.P.C. @ 174(3) (iv) of Cr.P.C., was enquired into and the same has been closed as mistake of fact on 03.05.2012 and a referred charge sheet has been filed before the learned Judicial Magistrate I, Sangagiri. 4.Recording the said submission of the learned Additional Public Prosecutor, this petition is closed, with a liberty to the petitioner, to workout his remedies in the manner known to law.
