CRIME NO.1677 OF 2020 For Petitioner : M/S.S.THIYAGARAJAN Advocate For Respondent : MR.T.SHUNMUGARAJESWARAN Govt. Advocate ( Crl. Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner apprehends arrest at the hands of the respondent police for the offences punishable under Sections 8(C), 20(b) (ii) (B), 25 and 29(1) of Narcotic Drugs and Psychotropic Substances Act, 1985, in Crime No.1677 of 2020, seeks anticipatory bail.

2. When the mater is taken up for hearing the learned Government Advocate appearing for the respondent Police submitted that the petitioner has moved anticipatory bail petitions before this Court many times and the same were also dismissed. He further submitted that by suppressing the orders of dismissal, the present petition has been filed.

3. The learned Counsel appearing for the petitioner seeks permission of this Court to withdraw the petition.

4. Though this Court is of the view that action should be initiated against the petitioner for willful suppression of the earlier orders of dismissal and filing the present petition to gain relief, however, in view of the request of the learned counsel for the petitioner, this Court, takes a lenient view and is inclined to permit the petitioner to withdraw the present petition subject to the condition that the petitioner shall pay a cost of Rs.5,000/- to the Chief Justice's Relief Fund, High Court, Chennai, within a period of two weeks from today.

5. The Registry is directed to ensure receipt of the cost awarded by this Court is paid and if the same is not paid within the time stipulated above, necessary action shall be taken in accordance with law for recovering the said amount from the petitioner. Registry is further directed to ensure that petitions, suppressing earlier orders of dismissal are not entertained in future without proper scrutiny.
