(This case has been heard through video conference) This Criminal Original Petition has been filed to call for the records and quash the proceedings in C.C.No.7923 of 2017 on the file of the learned IV Metropolitan Magistrate, Saidapet, Chennai.

2. The learned counsel for the petitioner submits that the petitioners are aged about 38 & 80 years. Therefore, this Court may consider dispensing with the personal appearance of the petitioners before the Court below.

3. Taking into consideration the request as made by the learned counsel for the petitioners, the appearance of the petitioners before the trial Court is dispensed with except for their appearance for the purpose of receiving the copy of the proceedings under Section 207 Cr.P.C., framing of charges, questioning under Section 313 of Cr.P.C., and on the day on which judgement is to be pronounced. The Trial Court is directed to dispose of the case within a period of six months from the date of receipt of a copy of this order. The petitioners are permitted to raise all the grounds before the trial Court. This Criminal Original Petition is disposed of. Consequently connected Miscellaneous Petitions are closed.
