Petition praying that in the circumstances stated therein and in the Memorandum of Grounds in CRL A.655/2017 on the file of the High Court, the High Court will be pleased to suspend the sentence and enlarge the petitioner on bail pending disposal of the appeal preferred against the conviction and sentence passed in C.C.No.126/2011 dated 27/09/2017 by the Special Court for the cases under prevention of Corruption Act at Chennai, CRL A.655/2017 [IN CRL.MP.NO.15041 OF 2017] Order : This petition coming on for orders upon perusing the petition and the Memorandum of Grounds in CRL A.655/2017 on the file of the High Court and upon hearing the arguments of M/S.G.THANGAVEL, Advocate for the petitioner and of MR.P.GOVINDARAJAN ADDITIONAL PUBLIC PROSECUTOR on behalf of the Respondent the court made the following order:- This petition has been filed to suspend the sentence of imprisonment imposed in the judgment dated 27.09.2017 made in C.C.No.126 of 2011 on the file of the Special Court for the cases under Prevention of Corruption Act at Chennai.

2. This Court has already considered the grounds of appeal and admitted the appeal preferred by the petitioner. Now, the petitioner seeks suspension of sentence. It is submitted that the fine amount of Rs.50,000/- has been paid by the petitioner on 02.11.2017.

3. Considering the averments made in the bail petition, this Court is inclined to suspend the sentence and enlarge the petitioner R.Punithakumar/3rd accused in C.C.No.126 of 2011 on bail with the following condition that i) the petitioner shall deposit a sum of Rs.1,00,000/- (Rupees One Lakh only), to the credit of C.C.No.126 of 2011 on the file of the Special Court for the cases under Prevention of Corruption Act at Chennai within a period of three weeks from the date of the receipt of a copy of this Order and also (ii) the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten thousand only) with two sureties each for a like sum to the satisfaction of the Special Court for the cases under Prevention of Corruption Act at Chennai, within the said period and also (ii) the petitioner shall appear before the said trial Court on the first working day of every English calendar month, at 10.30 am, until further orders.
