This Application is filed for a direction to the respondent to furnish security to the extent of the suit claim or in case of failure to attach the suit schedule property.

2. This Court, upon hearing the Learned Counsel for the applicant on 07.01.2020, directed the defendant/respondent to furnish security. On receipt of the notice, the defendant entered appearance and reported to this Court that he has furnished security. However, in spite of several adjournments and also permitting the respondent/defendant to furnish alternate security for nearly more than a year, the respondent is not really taken any serious steps to furnish security. But on the different pretext had been taking adjournments.

3. The Registry has brought to the notice of this Court, the photocopies of documents filed by the respondent in the name of furnishing security. The said photocopies have no relevance are nothing near the requirement or furnishing security.

4. This Court is convinced that the respondent/defendant just to evade the order of this Court, had being pretending to furnish security but, in fact, had not come forward to furnish security. This makes it very clear that if the plaintiff succeeds in the suit, it will be very difficulty for him to recovery the decree amount. Hence, attachment before judgment of the schedule property is ordered.

5. Post the matter after four weeks.
