ORDER
This Criminal Appeal has been filed by the appellant/accused to set aside the impugned order in Crl.M.P.No.796 of 2025 in Crime No.89 of 2025 dated 19.03.2025 passed by the Principal Sessions Judge, Kishnagiri District and to enlarging the appellant on bail in such terms and conditions that my be imposed by this Court.
2. The learned counsel for the appellant submits that there is a case in counter against the defacto complainant registered in Crime No.90 of 2025 for the offence under Section 296(b), 118(1) and 351(3) of B.N.S.
3. It is seen that the case in Crime No.89 of 2025 has been registered against the petitioner and others for the offence under Sections 3(1)(r), 3(1)(s), 3(2)(va) of SC/ST (PoA) Amenment Act, 2015 along with other IPC offences.
4. It is settled proposition of law that while hearing the bail application of an accused involving SC/ST Case, the victim must be heard, whereas, in this appeal, the appellant has not impleaded the victim of this case. 2/4
5. Therefore, this Criminal Appeal is dismissed.
6. However, the appellant is at liberty to file a fresh petition by impleading the victim.
