ORDER

With consent, the main Writ Petition itself is taken up for final disposal at the admission stage.

2. The present Writ Petition has been filed to call for the records in the Impugned E-Tender dated 17.02.2026 with reference No.1/ALEHCS/6316/2025/A4 and quash the same.

According to the petitioner, he is a resident of Adhanur Village, Madhampakkam, Kanchipuram District and in the year 1986, the petitioner occupied a piece of vacant land in Adhanur village to an extent of 250 sq.ft., which falls under Survey no.361/1B in the Adhanur Village and subsequently constructed a concrete house. While so, on 24.04.2017, the petitioner received a notice wherein the petitioner's possession was objected as against

the 4th respondent - Society. Further, on verification of records, it came to light that the land, which was earlier designated for the purpose of allocation to the members of the 4th respondent-society for housing plots for 1200 employees working in M/s Ashok Leyland was acquired by the State Government for north madras Thermal power station project and in lieu thereof an assignment of alternative lands. Even though the intention of the 1st respondent in issuing tenders for sale or lease of such shop premises, is to ensure transparency, fair competition and value for money in the management of public property by using a formal, open and regulated process, the inclusion of such shop premises in the impugned tender that are not even in possession of the 4th respondent acts directly in derogation with law and established procedure, thereby pleaded for appropriate orders.

3. The learned counsel appearing for the petitioner would submit that the impugned auction has been issued for the property, in which the petitioner is in possession and enjoyment for more than 40 years, thereby pleaded to allow the writ petition.

4. Heard the learned counsel appearing for the petitioner and the learned Special Government Pleader appearing for the respondents and perused the entire documents placed on record.

5. On perusal of the entire facts of the case, it is seen that the petitioner neither possessed property tax nor possessed title, therefore, the prayer of the petitioner to quash the impugned auction cannot be granted and hence the present Writ Petition is dismissed, however, taking note of the submission of the learned counsel appearing for the petitioner, the petitioner is at liberty to participate in the auction. Consequently, connected miscellaneous petitions are closed. No costs.
