ORDER

This Criminal Revision Case has been filed by the petitioner to set aside the order dated 18.02.2025 made in Crl.M.P.No.93 of 2025 on the file of the Additional District Judge/Presiding Officer Special Court for Essential Commodities Act Cases, Coimbatore.

2. The case of the petitioner is that the petitioner's mobile phone (MYEA3HN/A IPHONE, 16) was seized by the respondent police from her son-in-law in connection with a case in Crime No.467 of 2024. Thereafter, the petitioner filed a petition in Crl.M.P.No.93 of 2025 before the Additional District Judge/Presiding Officer Special Court for Essential Commodities Act Cases, Coimbatore seeking return of property, but the said petition was dismissed by order dated 18.02.2025. Hence, challenging the same, the present revision is filed.

3. According to the learned Additional Public Prosecution submitted that the investigation is already completed and awaiting for FSL report for filing 2/5

the final report. However, he submitted that the said property is not necessary for further investigation or for trial.

4. In view of the above, the order passed by the learned Judge in Crl.M.P.No.93 of 2025 dated 18.02.2025 is set aside.

5. The Additional District Judge/Presiding Officer Special Court for Essential Commodities Act Cases, Coimbatore, is directed to give interim custody of the property/mobile phone to the petitioner by imposing conditions and obtaining appropriate undertaking that as and when the property is required, the petitioner would produce the same.
