ORDER
This Criminal Original Petition has been filed to direct the learned Judicial Magistrate - I, Tambaram to dispose of the case in CC.No.456 of 2025 within a time frame to be fixed by this Court.
2. The petitioner / defacto complainant lodged a complaint in Crime No.59 of 2021 for an offence under Sections 420, 465, 467, 468, 471 & 120 (b) of IPC against the accused persons on 21.05.2021. After completion of investigation, charge sheet has been filed against 11 accused. On 06.08.2025, the said charge sheet has been taken on file as C.C.No.456 of 2025.
3. During the pendency of investigation, A1 to A3 have obtained bail, A5 and A6 were arrested and granted bail. A8, A9, A10 and A11 were enquired under Section 41 A of Cr.P.C.
4. After filing the charge sheet, the accused persons who have obtained bail and anticipatory bail were evading the summons and not appearing before the Trial Court. The respondent police seems to be not taking any serious effort in serving the summons or obtaining warrant against them. Hence the petitioner had filed the present petition.
5. The learned Additional Public Prosecutor submitted that the respondent Police have filed the charge sheet stating that in this case totally 11 accused are there. A4 and A7 have died. With regard to A1 to A3, A9, A10 and A11, notices were served. Already, A5, A6 and A8 are appearing regularly before the Trial Court. Except the two accused persons viz., A4 and A7 all the other remaining accused have been served and the case stands posted for the
appearance of all the accused on 04.05.2026. Necessary steps will be taken to mark the presence of the accused persons. In this case totally 17 witnesses were listed.

Considering the submissions made on either side and on perusal of the materials available on record, it is seen that the final report has already been filed and taken on file in C.C.No.456 of 2025 on the file of the learned Judicial Magistrate-I, Tambaram. It is further reported that except A4 and A7, who are no more, summons have been served on all the remaining accused and the case is now posted for their appearance.
7. In view of the above developments, this Court is of the opinion that appropriate directions can be issued to ensure expeditious progress of the trial.
8. Accordingly, the learned Judicial Magistrate-I, Tambaram, is directed to take effective steps to secure the presence of the accused and proceed with the trial in accordance with law.
9. Considering that as many as 17 witnesses have been cited, the learned Magistrate is further directed to dispose of C.C.No.456 of 2025, as expeditiously as possible, preferably within a period of nine months from the date of receipt of a copy of this order.
10. With the above direction, this Criminal Original Petition is disposed of.
