Respondent (Crime No.26 of 2015) PRAYER: Criminal Miscellaneous Petition is filed under Section 482 Cr.P.C., to modify the condition of payment imposed upon the petitioner/appellant in Crl.M.P.No.8070 of 2020 in C.A.No.502 of 2020 dated 22.12.2020 on the file of this Hon'ble Court that the petitioner is directed to give a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each to the sons of the deceased namely, Chinnathambi and Jagannathan on or before 19.01.2021. O R D E R

(The case has been heard through video conference) The petitioner was granted suspension of sentence by order dated 22.12.2020 in Crl.M.P.No.8070 of 2020. He was however, directed to pay a sum of Rs.25,000/- to the sons of the deceased on or before 19.01.2021. The petitioner was unable to mobilize the said amount. Therefore, even though bail was granted, till date the petitioner is languishing in prison.

2.The petitioner's counsel states that the petitioner can only deposit a sum of Rs.10,000/-. I direct that on such deposit, the petitioner will be enlarged on bail. The earlier order dated 22.12.2020 in Crl.M.P.No.8070 of 2020 is modified, accordingly. The petitioner shall pay a sum of Rs.10,000/- to the sons of the deceased.

3.This criminal miscellaneous petition is allowed on the said terms.
