Writ Petition is filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus directing the second respondent to consider the representation of the petitioner dated 15.05.2015 in the light of the orders issued by the Government in G.O.(Ms) No.154, P & A.R. Department dated 19.09.2006 and G.O.(Ms) No.216 Labour and Employment Department, dated 15.11.2007 so as to consider his case in any other Department also within a reasonable period as may be fixed by this Court.

Mr.S.Gunasekaran, learned Government Advocate, takes notice for the respondents.

The petitioner's father was working as Male Nursing Assistant in the Primary Health Centre at Thali and he died in harness on 02.05.2009. After demise of the petitioner's father, he has applied for compassionate appointment and has also made representations on 08.11.2011 and 07.01.2013 and the same are pending consideration. Further, the petitioner made representation on 15.05.2015 to the second respondent seeking compassionate appointment in the light of the orders issued by the Government in G.O.(Ms) No.154, P&A.R. Department dated 19.09.2006 and G.O.(Ms)No.216 Labour and Employment Department, dated 15.11.2007, but till date no order has been passed on the said representation. Therefore, the petitioner has filed the above writ petition. 3.

At the time of hearing, the learned counsel appearing for the petitioner prays for a direction to the second respondent to consider and pass orders on the representation of the petitioner dated 15.05.2015 seeking compassionate appointment in the light of the Government Orders in G.O..(Ms)No.154, P&A.R. Department dated 19.09.2006 and G.O.(Ms)No.216 Labour and Employment Department, dated 15.11.2007.

In view of the narrow prayer made, without going into the merits of the case, the second respondent is directed to consider and pass orders on the aforesaid representation dated 15.05.2015 in the light of the Government orders referred to above, within a period of twelve weeks from the date of receipt of a copy of this order.
