Learned counsel for the petitioner filed a memo dated 21.08.2025 stating that, in this transfer petition, inadvertently, the prayer has been wrongly sought for as if the petitioner seeks transfer of HMOP.No.1522 of 2024 pending on the file of the Family Court, Coimbatore to the file of the Family Court, Thiruvarur instead of Sub Court, Thiruvarur and thereby, this Court, while allowing this transfer petition, ordered for transfer of HMOP.No.1522 of 2024 to the file of the Family Court, Thiruvarur.
3. The said memo filed by the petitioner is recorded and the Registry is directed to carry out the aforesaid correction in respect of the name of the transferee Court in the order dated 18.06.2025 and issue a fresh copy of the order to the learned counsel for the parties. 28.08.2025 skt

ORDER
The petitioner is the wife/respondent in HMOP No.1522 of 2024 filed by respondent / husband before the Family Court, Coimbatore. 2.
The respondent despite service of notice in the above Transfer
CMP, has not chosen to appear either in person or through Counsel. The name of the respondent is also printed in the cause list. Therefore, the respondent is called and set ex-parte.

Learned Counsel for the petitioner took me through the averments in the transfer CMP and also specifically pointed out that HMOP has been filed by the petitioner for restitution of conjugal rights which is pending in HMOP.No.80 of 2024, before the Principal Sub Court, Thiruvarur. The present HMOP No.1522 of 2024, which sought to be transferred has been filed by the respondent husband to dissolve the marriage with the petitioner wife. In order to avoid conflicting orders and multiplicity of proceedings, it would be just and proper to ensure that both the proceedings are tried together.

In view of the above, the Tr.C.M.P.No.405 of 2025 is allowed and HMOP.No.1522 of 2024, pending on the file of Family Court, Coimbatore is withdrawn and transferred to the file of the Family Court, Thiruvarur, and to be taken up jointly with HMOP.No.80 of 2024. 5.
The Family Court, Coimbatore is directed to send the entire records relating to HMOP.No.1522 of 2024 to Family Court, Thiruvarur
forthwith.

The learned Family Court, Thiruvarur is directed to take up the HMOP.No.1522 of 2024 along with HMOP.No.80 of 2024 and dispose of the same expeditiously, in a manner known to law. No costs. Consequently, connected miscellaneous petition is closed.
