ORDER

The wife has come before this Court seeking transfer of divorce petition H.M.O.P.No.131 of 2013 filed by the respondent/husband from the file of Sub Court Hosur to the file of Family Court, Salem to be tried along with M.O.P.No.292 of 2014 filed under Section 9 of the Hindu Marriage Act, 1955 for restitution of conjugal rights. 2.

Though the respondent was served with the notice and his name appears in the cause list, no one enters appearance. Therefore, this court proceeds to decide the matter on merits. 3.

Since the petitioner is living with her parents along with her children in Salem, it is very difficult for her to travel Hosur, which is 200 kilometer away from Salem to attend the court proceedings. Hence, it is appropriate to withdraw H.M.O.P.No.131 of 2013 on the file of Sub-Court, Hosur and transfer the same to the file of Family Court, salem, where M.O.P.No.292 of 2014 and M.C.No.23 of 2013 filed by the petitioner are pending to be tried all the matters together. The Family Court, Salem is directed to dispose of all the matters together at the earliest.
