Challenge has been made to the allowing of the application filed by the revision petitioner to condone the delay in filing an application to set aside the exparte decree on payment of Rs.2,00,000/- to the decree holder as part payment on or before 20.01.2025 and as the revision petitioner has not paid the amount, the present Civil Revision Petition has been filed.

2. When the matter is taken up today, the learned counsel appearing for the petitioner submitted that in the Execution Petition an Order of attachment has been Ordered and goods have been removed and further he has also paid a sum of Rs.15,77,000/- and in this regard he has also filed a memo before the Execution Court. Based on the said memo, the matter has been referred to mediation and posted on 18.07.2025. In such view of the matter, nothing survives for adjudication in this petition.

3. Accordingly, this Civil Revision Petition is dismissed as infructuous. No costs. It is for the petitioner to seek remedy before the Executing Court. The Execution Court shall take note of the further development in this regard and pass necessary Orders. Consequently, connected miscellaneous petition stands closed.
