This Civil Miscellaneous Petition has been filed to condone the delay of 247 days in filing the above CMA.

2. Heard the learned counsel for the petitioner. He submit that due to untimely demise of 1st petitioner in the accident, she was subjected to severe financial constraints and has been struggling to run her family containing three girl children and she can be able to file the appeal only after attaining financial stability. In the meantime, there occurred a delay of 247 days in filing the appeal. Hence, he prayed for condoning the delay in filing the appeal.

3. Inspite of service of notice on the 1st respondent and his name being printed in the cause list, there is no representation for him either in person or through counsel.

4. Learned counsel for the 2nd respondent is having objection for allowing this petition stating that the delay in filing the appeal is huge.
