O R D E R

This Criminal Original Petition has been filed to direct the first respondent to transfer the investigation in Crime No.36 of 2022 on the file of the Inspector of Police, Velankanni Police Station, second respondent.

2. Heard Mr.R.Sankarasubbu, learned counsel appearing for the petitioner and Mr.A.Gokulakrishnan, learned Additional Public Prosecutor for the respondents.

3. The learned counsel appearing for the petitioner submitted that the respondent Police had registered the First Information in Crime No.36 of 2022 for the offences punishable under Section 174 of the Indian Penal Code. But the Police has to register the case of the petitioner under Section 306 of the Indian Penal Code.

4. The learned Additional Public Prosecutor submitted that after thorough investigation, it is found that it is case of suicide, due to frustration Police have filed negative report.

5. In such a view of the matter, the respondent Police is directed to serve the copy of the report to the defacto complainant. It is well open to the petitioner to proceed in accordance with law.

6. With the above direction, this Criminal Original Petition is disposed of.
