Crime No.1656 of 2010 ..Respondent Prayer:- Criminal Appeal filed under Section 374(2) Cr.P.C., against the Judgment dated 10.07.2012 passed in S.C.No.57 of 2011 on the file of the Principal Sessions Judge, Salem. For Appellant: No appearance For Respondent: Mr.M.Maharaja, Additional Public Prosecutor, JUDGEMENT (Judgment of the Court was delivered by S.Nagamuthu.J) The appellant is the sole accused in S.C.No.57 of 2011 on the file of the Principal Sessions Judge, Salem. He has been convicted under Sections 302 and 506(ii) IPC. The trial Court has sentenced him to undergo life imprisonment and to pay a fine of Rs.1,000/- for the offence under Section 302 IPC and sentenced him to undergo RI for three months for the offence under Section 506(ii) IPC. Challenging the said conviction and sentence, the appellant is before this Court with this Criminal Appeal.

2. Today, when the matter was taken up for hearing, there was no representation for the appellant. The learned Additional Public Prosecutor submitted that the sole appellant died on 30.07.2014. According to him, in connection with his death, a criminal case has been registered in Crime No.309 of https://hcservices.ecourts.gov.in/hcservices/

2014 for the offences under Sections 120(B) and 302 IPC on the file of the Salem Town Police Station. The learned Additional Public Prosecutor has also produced the Postmortem Certificate of the appellant/deceased. In view of the same, the Criminal Appeal stands abated and accordingly, the same is dismissed.
