Respondent Prayer: Petition filed under Section 24 of the Civil Procedure Code praying to withdraw the cases bearing H.M.O.P.No.22 of 2016, on the file of the learned Family Court Judge, Thiruvallur and transfer the same to the file of the learned Subordinate Judge at Kancheepuram, Kancheepuram District and try along with H.M.O.P.No.216 of 2015 on its file.

The wife in a matrimonial proceedings has filed the above transfer Civil Miscellaneous Petition seeking to withdraw H.M.O.P.No.22 of 2016 pending on the file of the Family Court, Tiruvallur and transfer the same to the file of Sub Court, Kancheepuram. The husband has filed the above H.M.O.P.No.22 of 2016 under Section 9 of the Hindu Marriage Act, before the Family Court, Tiruvallur for restitution of conjugal rights.

2. The husband who is the respondent herein has filed his counter, stating that the H.M.O.P.No.22 of 2016 may be transferred either to Sub Court, Poonamallee or Principal Family Court, Chennai.

3. Mr.K.Balu, learned counsel appearing for the petitioner/wife does not have any objection for transferring the above H.M.O.P.No.22 of 2016 to any of the Family Court in Chennai.

By consent of both counsels, this Transfer Civil Miscellaneous Petition is disposed of and H.M.O.P.No.22 of 2016 pending on the file of Family Court, Thiruvallur is withdrawn and transferred to any other Family Court in Chennai.
