O R D E R

The present criminal original petition has been filed to direct the respondent to register a case on the complaint given by the petitioner on 09.01.2016.

2. The petitioner is residing at Door No.33/56, LIG-I, TNHB, Avadi, Chennai - 600 054. One Ruba, Rekha and Sridhar, who is the husband of Ruba. They started chit fund business. They induced the petitioner to pay a sum of Rs.9 lakhs chit amount. The petitioner also paid the instalment amounts periodically and the petitioner had paid the entire chit amount of Rs.9 lakhs. Out of the said chit amount, only a sum of Rs.2,00,000/- has been paid to the petitioner. The said accused persons cheated the petitioner by not paying the remaining chit amount. Hence the petitioner lodged a complaint before the respondent police. But no action has been taken on the said complaint till date. Hence, the petitioner has come forward with the present criminal original petition.

3. I have heard the learned counsel appearing for the petitioner as well as the learned Additional Public Prosecutor appearing for the respondent.

4. The learned Additional Public Prosecutor submitted that on receipt of the complaint of the petitioner, C.S.R.No.37 of 2016 has been assigned and the matter is pending for enquiry.

5. In view of the submissions made on either side, this Court directs the respondent to conduct enquiry on the complaint given by the petitioner dated 09.01.2016 in C.S.R.No.37 of 2016 and and upon enquiry, if materials are gathered indicating commission of any cognizable offence, he is directed to proceed further in accordance with law.

6. This criminal original petition is disposed of accordingly.
