PUBLIC PROSECUTOR, Govt. Advocate ( Crl. Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent Police, for the offence under Section 376, 417 and 506(ii) IPC in Cr.No.24 of 2021, seeks anticipatory bail.

2. The case of the prosecution is that the defacto complainant and the petitioner had love affair and the petitioner promised to marry her and had sexual relationship. Later, he refused to marry the defacto complainant. Hence she lodged a complaint before the respondent Police.

3. It is seen from records that this is the second anticipatory bail petition filed by the petitioner. The previous order, dismissing the Criminal Original petition was passed by this Court on 19.04.2021.

4. The learned Government Advocate (Crl.Side) submits that there is no change in circumstances after the previous order was passed on merits. Hence, the learned Government Advocate vehemently opposed to grant bail to the petitioner.

5. In view of the submission made by the learned Government Advocate, further no change of circumstances arises for considering second bail petition.
