(The case has been heard through video conference) The petitioner, who was arrested and remanded to judicial custody on 13.07.2020 for the offence punishable under Sections 4(1)(aaa), 4(1)(g) r/w 4(1-A) of Tamil Nadu Prohibition Act, in Crime No.2051 of 2020, seeks bail.

2. The case of the prosecution is that on 13.07.2020, the petitioner was illegally found in possession of 160 litres of I.D.Arrack, thereby, the respondent police registered a case against the petitioner.

3. The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. He further submitted that the petitioner is in judicial custody from 13.07.2020.

4.The learned Government Advocate (Crl. Side) would vehemently opposed to enlarge the petitioner on bail on the ground that the petitioner was illegally found in possession of 160 litres of ID Arrack. He would further submit that the petitioner was arrested very recently on 13.07.2020 and that the petitioner has got 5 previous cases against him.

5.Considering the fact and circumstances and the petitioner is a habitual offender, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition stands dismissed.
