ORDER : The Court Made the following order :- The petitioner, who apprehends arrest for the alleged offences under Section Section 20(b) (ii) (A) of NDPS Act, 1985 in Crime No.152 of 2021, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that on 26.03.2021, the respondent police was on patrol, the petitioner along with other accused were selling ganja, on seeing the police they left their vehicle and flew away, on search, it was found that 300 gms of ganja in the vehicle. Hence, the law enforcing agency registered a case against the petitioner.

3. The learned counsel appearing for petitioner would submit that the petitioner has not committed any offence as alleged by the prosecution. Hence, he prays for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate(Crl side) appearing for the respondent would submit that there are totally two accused. The petitioner herein was arrayed as A2, A1 was arrested and he was still remanded in judicial custody. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

5. Taking into consideration the facts of the case and the A1 was arrested and he was still remanded in judicial custody, this Court is not inclined to grant anticipatory bail to the petitioner.
