The Criminal Original Petition filed under Section 482 of Code of Criminal Procedure to withdraw the proceedings in CC No.289 of 2016 pending on the file of the Learned Judicial Magistrate No.IV, Salem and transfer the same to the file of the learner Principal Sessions Judge, Salem to be tried along with SC.No.81 of 2015.

O R D E R

This Criminal Original Petition has been filed to withdraw the proceedings in CC No.289 of 2016 pending on the file of the Learned Judicial Magistrate No. IV, Salem and transfer the same to the file of the learned Principal Sessions Judge, Salem to be tried along with SC.No. 81 of 2015.

2. Heard the learned counsel for the petitioner as well as the respondent.

3. It is seen that the proceedings in CC No.289 of 2016 is pending on the file of the Learned Judicial Magistrate No. IV, Salem and the proceedings in SC.No.81 of 2015 is also pending on https://hcservices.ecourts.gov.in/hcservices/

the file of the learned Principal Sessions Judge, Salem, which are connected matters. There is a provision available in Cr.P.C., to transfer a case pending on a district to another court of same district where another case is pending. Accordingly, the petitioner is at liberty to file an appropriate petition before the one of the Court to transfer the another case and tried together.

4. In view of the above, this Criminal Original Petition is closed and liberty is granted to the petitioner to work out his remedy in the manner known to law. Consequently, connected Criminal Miscellaneous Petitions are closed.
