O R D E R

The petitioner is presently working as Deputy Director of Agriculture. The next avenue of promotion is to the post of Joint Director of Agriculture. There were certain earlier proceedings initiated by the petitioner for promotion. However, the petitioner was not given promotion. The petitioner is due to retire on 31.05.2015.

The petitioner submitted a representation on 16.11.2014, requesting the first respondent to give him promotion before the date of retirement as that would enable him to get more pension. The present request is to direct the first respondent to consider his representation on merits.

2. The proceedings dated 30.04.2013 on the file of the first respondent indicates that the department has recognised the claim of the petitioner with regard to seniority. It is for the first respondent to take a decision in this matter taking into account the date of retirement of the petitioner.

3. The first respondent is directed to consider and dispose of the representation submitted by the petitioner dated 16.11.2014 on merits and as per law. Such exercise shall be completed on or before 30.04.2015.

4. The writ petition is disposed of with the above direction. No costs.
