Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the 1st respondent to issue the petitioner's original degree certificate with Registration No.15MHE015. For Petitioner : Ms.V.Srimathi For Respondents : Mr.M.Ravi, for R1 to R5

O R D E R

This Writ petition has been filed seeking direction to the 1st respondent to issue the petitioner's original degree certificate with Registration No.15MHE015.

2. The case of the petitioner is that the petitioner completed her Master's degree in Technology in Electronics and Communication Engineering during May 2017 in the 6th respondent college, which is affiliated to the 1st respondent University. Though the petitioner completed her Masters in the year 2017, till date, the petitioner was not provided with her Original Degree Certificate, despite the several representations and complaints made by her. Hence, this Writ petition. 2/6

Learned counsel for the petitioner submitted that, when the petitioner approached the 6th respondent for issuance of Original Degree certificate, the 6th respondent informed the petitioner that, they have not received the petitioner's original degree certificate from the 1st respondent and directed the petitioner to approach the 1st respondent to know the exact status of her certificate, as the petitioner's original degree certificate was already issued by the 1st respondent. When the petitioner approached the 1st respondent University, she was made to run from pillar to post and at last, pursuant to the representation dated 07.02.2023 made by the petitioner, the 4th respondent, vide reply dated 07.03.2023 stated that, the petitioner's original certificate was already issued as per the University records.

Though the petitioner, vide representation dated 23.12.2022 sought for issuance of Original degree certificate, the 5th respondent issued a reply stating that, the competent authority has approved the request for issuance of duplicate certificate provided that the petitioner applies for the same through the University's portal and the above said acts of the respondents had put the petitioner to face great hardships and she is not able to secure any job or pursue further education.

Further, if the petitioner applies for issuance of duplicate certificate, it would imply that there are two certificates that have been issued and whoever is in possession of the petitioner's original degree certificate may use the same even for illegal purposes. Hence, she submitted that, it would suffice if this Court issues direction to the respondent University to issue the petitioner's original Degree Certificate to her as expeditiously as possible.

4. Learned counsel appearing for the respondent University submitted that, the petitioner will be issued with her Degree certificate within the time stipulated by this Court.

5. In view of the aforesaid submissions, this Court, without expressing any opinion on the merits of the case, directs the respondent university to issue the petitioner's Original Degree Certificate to her within a period of two weeks from the date of receipt of a copy of this order. 4/6

6. With the above observations and directions, this Writ petition stands disposed of. No costs.
