(Order of the Court was made by Dr.ANITA SUMANTH.,J.) This is a petition to condone the delay of 127 days in remitting the court fee.
2. Being satisfied with the reasons assigned in paragraph 5 of the accompanying affidavit, which is extracted below, the delay of 127 days in remitting the Court fee is condoned and this Miscellaneous Petition is ordered. '5. I respectfully submit that, following the passing of the Preliminary Judgment and Decree in C.S.No.56 of 2015, I preferred the above O.S.A. Before this Hon'ble Court. While filing the above O.S.A I prayed the original court fee paid in C.S.No.56 of 2015. While so, the above appeal was returned for complying certain mandatory things and the same was represented after due compliance. However, I was informed by my counsel that the Registry of this Hon'ble Court instructed to pay the court fee as pre the Tamil Nadu Court fees and suits valuation (Amendment) Act, 2017. Since, the Original suit was filed in year 2015, I paid the original court fee under bonafide intention.'
3. Registry is directed to number the Original Side Appeal, if it is otherwise in order, and list the same for admission.
