ORDER

The petitioner, who apprehends arrest at the hands of the respondent Police for the offences under Section 6(4) of TN Scheduled Commodities (RDCS) Order, 1982 r/w Section 7(1)(a)(ii) of Essential Commodities Act, 1955, in Crime No.242 of 2024 on the file of the respondent, seeks anticipatory bail.

2. The case of the prosecution is that the accused were found to be in illegal possession of 7400 kilograms of PDS rice. Hence the case.

3. Learned counsel appearing for the petitioner submitted that the petitioner is innocent and he has been falsely implicated in this case and this is his third anticipatory bail application before this Court. He further submitted that the petitioner is ready to abide by any stringent conditions that may be imposed on him. Hence, he prayed for grant of anticipatory bail to the petitioner.

4. Learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and opposed for grant of anticipatory bail to the petitioner stating that seven previous cases are pending against the petitioner.

5. Heard both sides and perused the materials available on record.

6. Considering the above facts and circumstances of the case, taking note of the nature of allegation, previous antecedents and also considering that the custody of the petitioner is very much required in this case, this Court is not inclined to grant anticipatory bail to the petitioner.
