JUDGMENT

The learned counsel for the appellant made a submission that the parties to the Appeal Suit had already settled the issues. Thus, no further adjudication needs to be undertaken in respect of the grounds raised in the Appeal Suit. Hence, the learned counsel for the appellant seeks permission of this Court to withdraw the present Appeal Suit. He has also made an endorsement to that effect.

2. In view of the submission and the endorsement made, the Appeal Suit stands dismissed as withdrawn. However, there shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
