ORDER

The petitioner / Accused, who apprehends arrest in the hands of the respondent police for the offences punishable under Section 4(1)(A) of T.N.P. Act in connection with the Cr. No.30 of 2026, seeks anticipatory bail.

2. The case of the prosecution is that on 13.03.2026, A1 was found in illegal possession of 18 nos of liquor bottles each weighing 1 litre and based on his confession statement, the petitioner herein / A2 has been implicated and hence the case.

3. The learned counsel appearing for the petitioner would submit that the petitioner is an innocent and he has been falsely implicated in this case. He would further submit that he is ready and willing to abide by any condition that may be imposed by this Court and prayed to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Criminal side) appearing for the respondent police reiterated the prosecution case and strongly opposed to grant anticipatory bail to the petitioner on the ground that 18 nos of liquor bottles, each weighing 1 litre, have been possessed by the accused and the same were recovered and investigation is pending.

5. The learned Government Advocate strongly opposed the bail application stating that this is a case of illegal possession of liquor bottles. Therefore, considering the nature of allegations against the petitioner that he has involved in the activities prohibited under the Tamil Nadu Prohibition Act, this Court is of the view that the petitioner does not deserve for anticipatory bail.

6. Accordingly, this Criminal Original Petition is dismissed. 26-03-2026 MJS Note:
