O R D E R

This Criminal Original Petition has been filed praying to direct the respondent to give police protection to the petitioner and his men, to continue and fulfill the work in Salai Agaram Village, East Pondy Road, Villupuram, on the basis of the complaint given by the petitioner before respondent Police on 22.06.2015.

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondent.

3. The learned Additional Public Prosecutor takes notice for the respondent.

4. In Crl.O.P.(MD)No.8004 of 2015 filed by this petitioner, following order has been passed by this Court : https://hcservices.ecourts.gov.in/hcservices/

"3. The learned counsel for the petitioner submitted that the Division Bench of this Court has dismissed the writ petition filed by various persons involving the similar issues and there is no law prohibiting the erection of cell phone tower. The learned counsel for the petitioner also relies upon the order of this Court in Crl.O.P.(MD) Nos.12680, 12681 and 12682 of 2014 dated 11.07.2014.

4. Considering the submissions made, without going into the merits of the case, it is hereby ordered that so long as the petitioner carries on legal activities in accordance with law, he cannot be prevented from doing so. For such activities, the petitioner is entitled for appropriate police protection. Accordingly, a direction is issued to the respondent police to give adequate police protection to the petitioner, in the light of the observations made, as and when required."

5. In view of the above, this Court holds that the petitioner will be entitled for appropriate police protection. Accordingly, a direction is issued to the respondent Police to give adequate police protection to the petitioner as and when required.

6. With the above direction, this Criminal Original Petition is closed.
