Learned counsel for the petitioner submitted that the prayer in the Tr.C.M.P has become infructuous and sought permission of this Court to withdraw the same and he has also made the following endorsement.
"H.M.O.P.No.06 of 2013 filed by the respondent-husband is dismissed for default on the file Subordinate Court, Cuddalore.
H.M.O.P.No.96 of 2014 filed by the petitionerwife for restitution is allowed on the file of the Sub Court, Mayiladuthurai ."

In view of the above submission made by the learned counsel for the petitioner and the endorsement so made, the Transfer Civil Miscellaneous Petition is dismissed is as infructuous. No costs. Consequently, connected miscellaneous petition is closed.
