The petitioner herein, who was called for enquiry on the complaint given by one Sampath Kumar alleging cheating to the tune of 1/4

Rs.60,00,000/- promising to execute the property in his name is under investigation, alleging that the police is harassing him. The present Criminal Original Petition is filed for a direction not to harass him under the guise of enquiry.

The learned Government Advocate (Crl.Side) appearing for the respondent police states that the complaint petition given by one Sampath Kumar is under investigation. The petitioner is expected to participate in the enquiry and produced the documents available with him, so that the Investigating Officer to rule out whether there is any cognizable offence made out or not. Instead of participating in the enquiry, the petitioner has approached this Court. 3.

Taking note of the submissions made by the learned counsels, it is suffice to direct the 1st respondent to cause notice to the petitioner herein as per law, calling for enquiry and appropriate decision will be taken.
