The suit is filed under Commercial Courts Act.

2. The 4th defendant has come out with written statement with the delay of 294 days. In the normal course, as per the limitation prescribed under the Commercial Courts Act, written statement was supposed to file within 30 days from the date of receipt of suit summon.

3. However, in view of the pandemic situation, the Hon'ble Supreme Court, suo moto has passed an order in Writ Petition No.3 of 2020 issued moratorium for reckoning limitation till 15th March 2021.

4. Therefore, the application to condone the delay is allowed. Written statement is taken on file.
