Respondents PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Certiorarified Mandamus, calling for the records relating to the Attachment Notice No.302 dated 08.02.2016 issued by the Respondents herein, quash the same as illegal and consequently forbear the respondents from insisting payment on revised rate of property tax.

ORDER

Mr.Salai Varun, learned counsel representing the counsel on record for writ petitioner and Mr.B.Anand, learned counsel for respondents are before this Court.

2. Learned counsel for writ petitioner submitted that a revision petition said to have been filed under Rule 85 of Rules under District Municipalities Act, 1920 has since been disposed of (dismissed on 18.06.2019).

3. Mr.B.Anand, learned counsel for respondents confirms this position.

4. Learned counsel for writ petitioner submitted that he has instructions to withdraw this writ petition, but seeks leave https://hcservices.ecourts.gov.in/hcservices/

to preserve the rights of the writ petitioner to assail the aforesaid order dated 18.06.2019 dismissing the revision petition.

5. Learned counsel for writ petitioner has made an endorsement to this effect in the case file, which reads as follows:

'I submit that I have instructions to withdraw the writ petition with liberty to assail the dismissal order passed in the Revision. I pray that this Hon'ble Court may be pleased to allow me to withdraw the writ petition.

6. In the light of the endorsement, this writ petition is dismissed as withdrawn preserving the rights of writ petitioner to assail the order dated 18.06.2019 made in the Revision Petition. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
