ORDER
By consent of both parties, this writ petition is taken up for final disposal at the admission stage itself.
2. This petition has been filed challenging the order of rejection of the petitioner's application seeking for issuance of legal heir certificate of her husband V.Pandian, the present writ petition has been filed.
3. It is the case of the petitioner that the petitioner is the first wife of the deceased V.Pandian and their marriage was solemnised on 14.09.1998 and they have begotten a girl child namely P.Elvarasi. The petitioner's husband died on 19.01.2017. It is the grievance of the petitioner that the petitioner's husband had developed relationship with one Dhayamani, married and two girl children are born through them. The second wife also died on 31.05.2021. Thereafter, the daughters of the second wife without arraying the petitioner and her daughter have fraudulently obtained legal heir certificate in their favour on 23.06.2021, hence, the petitioner applied for legal heir certificate which was rejected vide the impugned order. Challenging the said order, the present writ petition has been filed.
4. The learned counsel for the petitioner submitted that there is an effective appeal remedy before the Revenue Divisional Officer as against the rejection order passed by the second respondent, hence, seeks for a direction.
5. Heard both sides and perused the materials placed on record.
6. Considering the facts and circumstances of the case, this Court without going into the merits of the case directs the petitioner to file an appeal as against the order of the Tahsildar/second respondent before the concerned Revenue Divisional Officer within a period of four weeks from the date of receipt of a copy of this Order and thereafter, the concerned Revenue Divisional Officer shall conduct enquiry and pass appropriate orders on merits and in accordance with law after giving opportunity of hearing to the petitioner as well as the interested persons. Such exercise shall be completed within a period of eight weeks thereafter.
