..Respondents PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the 1st and 2nd respondents to consider the representation dated 01.02.2026 made by the petitioners herein and pass appropriate orders within stipulated time period as may be fixed by this Court and pass orders.

ORDER

The writ petition has been filed seeking a mandamus to the respondents 1 and 2 to consider the representations of the petitioners dated 01.02.2026.

2. The petitioners herein are employed in the 2nd respondent University in the posts of Office Assistant, Junior Assistant, Lab Assistant, Attender, Assistant and Sweeper respectively in the year 2005, 2006 and 2007 respectively on daily wage basis and subsequently they were converted as "consolidated staff" on 01.07.2010. The grievance of the petitioners is that while the services of similarly placed persons who were recruited along with them have been regularised on 12.09.2010, their services were not regularised till date, despite they having put in 20 years of service and sufficient vacant posts are available in the 2nd respondent University. Hence, they seek that their services be regularised on par with the similarly placed employees. In this regard, they have also submitted their representations 01.02.2026. However, the same was not considered to date. Hence, the petitioners are before this Court.

The learned counsel appearing for the petitioners has brought to the notice of the Court that some of the non-teaching staff of the 2nd respondent University had approached this Court in W.P.No.30924 of 2019 and had obtained an order of this Court on 23.10.2019. Pursuant to the directions of this

Court, their services have been regularised and hence, the same parity shall be extended to the petitioners herein also.

4. The learned counsel appearing for the 2nd respondent would submit that the representations submitted by the petitioners are bereft of particulars. 5.Heard the rival submissions and also perused the materials placed on record.

The counsel for the respondent has stated that the representations submitted by the petitioners are bereft of details, this argument cannot be countenanced for the simple reason that both in the affidavits and in the representations, the petitioners have claimed regularisation of their services, on account of the fact that they have been working in the 2nd respondent University since 2005, 2006 and 2007 etc., and had put in over 20 years of service. Therefore, a mandamus is issued to the 2nd respondent to consider the representations of the petitioners after giving them an opportunity of personal hearing, and orders shall be passed regularising the services of the petitioners. While considering the petitioners' representations, the 2nd respondent shall issue notice to the petitioners, who shall produce the documents evidencing their service in the 2nd respondentSociety. The entire exercise shall be completed within a period of six weeks from the date of receipt of a copy of this order.
