PRAYER:

The Second Appeal is filed under Section 100 of the Code of Civil Procedure, 1974 against the judgment and decree dated 31.01.2007 made in A.S.No.103 of 2004 on the file of the Principal District Judge, Chengalpattu, confirming the judgment and decree dated 29.01.2004 made in O.S.No.234 of 1998 on the file of the Additional Subordinate Judge, Chengalpattu.

O R D E R

The appellants 1, 3 to 11 and the respondents 1 to 5 along with their respective counsel on record are present. https://hcservices.ecourts.gov.in/hcservices/

2. A joint memo of compromise signed by the appellants 1, 3 to 11 and the respondents 1 to 5 and the learned counsel on record for the appellants and the respondents is filed before this Court. This Court personally enquired the parties about the compromise and the parties admitted the factum and the contents of the compromise and also expressed their willingness to have final decree in terms of compromise. The Joint Memo of Compromise is duly recorded.

3. In view of the Joint Memo of Compromise, final decree is passed for allotment of the shares and for recovery of the amount in terms of the compromise. In the event of execution of decree for recovery of amount, the necessary Court Fee may be collected in the Execution Proceedings.

The Second Appeal, is hence disposed of, in terms of joint memo of compromise filed by the parties and the Joint Memo of Compromise, dated 01.04.2015, shall form part of the decree. No costs.
