Mr.N.Suresh C O M M O N J UD G M E N T [Delivered by P.N.PRAKASH, J.] These Contempt Appeals deserve to be dismissed on the short ground that in the operative portion of the order under appeal, no punishment whatsoever has been imposed on the appellants. At this juncture, it may be appropriate to extract the operative portion of the common order dated 28.02.2020 passed by the learned Single Judge in Contempt Petition Nos.1223 to 1303 of 2011 :

"In the result, the Contempt Petitions are disposed of and all the 68 persons are directed to appear before the 3rd respondent/the Superintending Engineer, CEDC, Cuddalore along with the following original documents :

i. Aadhar Card;

ii.Voter Identity card;

iii.Driving License, if any and iv.Family Card/Ration Card.

The 3rd respondent after ensuring the production of the said documents shall pass appropriate orders for absorption.

Call on 16.04.2020 "for reporting compliance". A reading of the above shows that the learned Single Judge has not inflicted any punishment on the appellants and has merely adjourned the case for reporting compliance, to another date.

2. A bare reading of Section 19 of the Contempt of Courts Act, 1971, shows that an appeal will lie only if there has been any order or decision to punish for contempt. In the instant case, inasmuch as, in the order impugned, there is no order or decision imposing punishment on the appellants and there is only a direction to the appellants to consider and pass orders for absorption, the instant appeals are liable to be dismissed. Hence, all these Contempt Appeals are dismissed. Connected Sub Applications are closed.
