Respondents Prayer:- Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a writ of mandamus directing the respondents to grant ordinary leave for 30 days without escort to the detenu Komban @ Kombaiya, S/o.Esaki Devar, convict No.3867, detained at Central Prison, Vellore.

ORDER

(1) This writ petition has been filed by the petitioner requesting the authorities to grant thirty days leave to her husband, viz., Komban @ Kombaiya, S/o.Esaki Devar, without escort. The detenu now is confined at Central Prison, Vellore.

(2) Heard Mrs.P.Kritika Kamal, learned Government Advocate [Crl.Side] who accepts notice on behalf of the respondents. (3) Among other reasons seeking such relief, there is some medical ailments which is unfortunately faced by the convict/detenu.

(4) Let the 3rd respondent examine the said representation dated 15.04.2021 in the light of not only the facts mentioned in the said representation, but also in the light of the orders of the Hon'ble Supreme Court of India in this regard and at any rate, the said representation be considered and orders be passed on or before 21.05.2021.

(5) The writ petition stands disposed of accordingly. No costs.
