Prayer : Transfer Civil Miscellaneous Petition is filed under Section 24 of the Code of Civil Procedure to withdraw the H.M.O.P.No.11/2014 pending on the file of the Sub Court at Gingee and transfer the same to the Principal Sub Court at Tiruvannamalai. For Petitioner : Mr.B. Jawahar
ORDER
Petitioner/wife has filed this transfer petition to transfer the H.M.O.P.No.11 of 2014 filed by the husband for divorce on the file of Sub Court, Gingee to the Principal SubCourt, Tiruvannamalai where H.M.O.P.No.121 of 2014 filed by the petitioner/wife before the Principal Sub Court, Tiruvannamalai, for restitution of conjugal right is pending.
2. Though the respondent was served and his name was printed in the cause-list, no one appeared. Hence, this Court is inclined to decide the matter on merits. Since the petitioner is residing in a village in Tiruvannamalai Taluk and it is very difficult for her to travel from her native place to Tiruvannamalai and from Tiruvannamalai to Gingee, this petition is ordered to be transferred from the file Sub Court, Gingee to the file of Sub-Court, Tiruvannamalai.
